Gender on Death Certificates in Colorado 🏳️🌈🏳️⚧️
As of 2026, Colorado House Bill HOUSE BILL 25-1109 will allow people's gender on death certificates to be listed as Male, Female, or X (non-binary).
However, if your gender assigned at birth does not match the gender you want on your death certificate, it's important to know that for this to happen, someone must have one of the following documents:
(a) A COURT ORDER APPROVING A LEGAL NAME OR GENDER CHANGE;
(b) WRITTEN INSTRUCTIONS FROM THE DECEDENT;
(c) A HEALTH-CARE DIRECTIVE;
(d) PROOF OF CLINICAL TREATMENT FOR A GENDER TRANSITION;
(e) DOCUMENTATION OF A CHANGE TO THE GENDER MARKER ON THE DECEDENT'S BIRTH CERTIFICATE; OR
(f) A DRIVER'S LICENSE.
So, make sure you either document this for yourself, and/or designate someone you trust to carry out your end of life arrangements.
